Recently, the U.S. Environmental Protection Agency (USEPA) published a regulation that clarifies when a discharge permit is required under the Clean Water Act (CWA) for trans-basin water transfers. This article discusses the question of whether a NationalPollutant Discharge Elimination System(NPDES) permit is requiredbecause the movement of surfacewater from one basin to another to servemunicipal, agricultural, and commercialneeds may also result in the movement ofpollutants from one water body to another.
